<h2>The clock your insurer is on in Texas</h2>
<p>The Texas Insurance Code sets hard deadlines on claim handling. They are not guidelines, and missing them costs the carrier money.</p>

<p>3 things change those numbers:</p>
<ul>
<li><strong>Surplus lines carriers get longer.</strong> A non-admitted insurer has 30 business days to acknowledge and 20 business days to pay. Gulf Coast commercial property is often written this way, so check the carrier name on your declarations page before you start counting.</li>
<li><strong>Disasters push everything back.</strong> After a declared disaster, the Texas Department of Insurance can extend every claim deadline by 15 days. Expect that after a named storm.</li>
<li><strong>Missing a deadline has a price.</strong> Under Section 542.060, an insurer that violates the prompt payment rules owes 18% a year in interest on the claim amount plus reasonable attorney&#8217;s fees. Weather-related claims fall under Chapter 542A, where the interest is calculated on a different formula tied to the Finance Code rate, so confirm which one applies to your loss.</li>
</ul>

<h2>3 gaps that stall Houston commercial claims</h2>
<h3>Your wind and hail deductible is a percentage, not a dollar figure</h3>
<p>Texas commercial wind and hail deductibles commonly run 1% to 5% of insured value rather than a flat amount. On a building and contents insured for $2 million, a 2% deductible is $40,000 out of pocket before the carrier pays anything. That is the number that surprises people, because the all-other-perils deductible on the same policy might be $5,000.</p>
<p>Named storm deductibles work the same way and trigger once the National Weather Service or National Hurricane Center names the system. Check whether yours applies per event, per season, or per calendar year. 2 named storms in one season can mean paying it twice.</p>
<h3>Flood is not in your commercial property policy</h3>
<p>Standard commercial property forms exclude flood. Rising water, storm surge, and street flooding are a separate purchase, and it is a common reason a Houston storm claim is denied outright. The National Flood Insurance Program caps non-residential coverage at $500,000 for the building and $500,000 for contents. If your warehouse holds more inventory than that, excess flood sits on top of the NFIP layer.</p>
<p>Wind-driven rain entering through a storm-created opening is usually a property claim. Water that rose from the ground is usually a flood claim. Adjusters draw that line early, so document where the water came from before cleanup starts.</p>
<h3>Windstorm east of Highway 146 follows different rules</h3>
<p>The Texas Windstorm Insurance Association covers 14 first-tier coastal counties, including Brazoria, Chambers, Galveston, and Jefferson, plus the part of Harris County east of Highway 146. Commercial buildings, business personal property, townhouses, and condominiums are all eligible. To qualify, the structure needs WPI-8 certification from TDI confirming it was built to the applicable windstorm building code.</p>
<p>If your building sits east of that line, wind may be written through TWIA rather than your main carrier, which means a separate policy, a separate deductible, and a separate claim. Buildings west of it carry wind on the standard policy. Knowing which applies before a storm saves weeks.</p>
<h2>What to do in the first 72 hours</h2>
<ol>
<li><strong>Report it the day you find it.</strong> The 15-day acknowledgment clock starts when you file, not when the damage happened.</li>
<li><strong>Photograph everything before cleanup.</strong> Include serial numbers on damaged equipment and the water line on the walls. Video walkthroughs are better than stills for large losses.</li>
<li><strong>Make reasonable temporary repairs and keep the receipts.</strong> Most policies require you to prevent further damage, and that cost is usually reimbursable.</li>
<li><strong>Log every call.</strong> Date, name, what was said. This is what turns a prompt payment dispute into a provable one.</li>
<li><strong>Send documents in a way that creates a record.</strong> The 15-business-day decision clock only starts once the carrier has received everything it requested.</li>
<li><strong>Pull your business interruption records now.</strong> Lost income claims need profit and loss statements and payroll records. Assembling them late is one of the most common self-inflicted delays.</li>
